Implementation
Townsville Helicopters preserves the technical control of the aircraft chartered and its crew. All persons or goods carried on board the aircraft are subject to the authority of the pilot in command and to the conditions specified by Townsville Helicopters.
Delay, interruption, cancellation or diversion by Townsville Helicopters
Townsville Helicopters or the pilot in command, in the event of circumstances beyond their control (aircraft defect, weather or performance limitations etc.) may:

delay, interrupt or cancel the charter

delay, interrupt or cancel a flight

may return to a starting point, or,
-
divert the aircraft to an intermediate point
In all such circumstances, Townsville Helicopters incurs no liability and cannot be prosecuted for prejudices sustained by the charterer or others. Furthermore, in all such cases, the charterer will nonetheless pay Townsville Helicopters the costs incurred.
Customer cancellation policy
No charge if cancellation occurs up to 48 hours before the agreed departure time.
50% of the total charter fee will be charged if the charter is cancelled between 24 and 48 hours before the scheduled departure time.
100% of the charter fee is payable if the charter is cancelled less than 24 hours before the planned departure time.
Limit of liability
Townsville Helicopters Pty Ltd carries third party and passenger liability.
